Buying a property in Spain
Investing in a property in Spain can take time and effort. Spanish laws and regulations, requirements for estate agents, documentation, financing, and settlement/transaction of properties are entirely different from what it is in many other countries.
As your buying agent, we assist you throughout the buying process
Before a viewing tour, we create a requirement specification based on your wishes, budget and needs. This can be done by email or over the phone. We are happy to send you some suggestions of properties to discuss price levels, areas or qualities.
Before a viewing trip, all viewings and times are agreed upon. Then, we will pick you up at the airport, hotel, or home. As Buyer's Agents, we have built a network of reputable estate agents, property developers and sellers.
We aim to help you find your perfect property and secure your investment.
Benefits of using a Buyer's Agent
We will be your single point of contact throughout the buying process, liaising directly with other estate agents, lawyers, surveyors, banks and other advisors on your behalf.
You don't have to visit many different estate agents to get an overview of the properties on the market.
You don't have to organise viewings with many different estate agents.
We act as advisors in contract negotiations and the bidding process.
you benefit from our excellent network of lawyers, technical advisers, valuers and architects. Search assignments, using a Buyer's Agent is a service that is free of charge (The seller's agent share the sales commission from the seller of the property)
The Property Search
We will find the property that is just right for you
We know that you have your own unique requirements when buying a property that is just right for you. This could be the desired area/location (near the beach, golf course, child-friendly, accessibility, standard etc.) or th etype of architecture, design or living qualities such as security, services, facilities etc.
If desired, a viewing tour of possible different areas and complexes can be organised before the requirements are finalised, and we can start our search mission in the market.
To find the best properties available on the market that matches your requirements, we review our portfolio of properties and our network of estate agents, property developers and home sellers.
We optimise your investment.
Once we have found the property you wish to buy, we will assist you with offers and negotiations with the seller's agent.
The choice of strategy in a negation process will be based on our knowledge of the price level of similar properties, knowledge of ownership, attractiveness in the market and how long the property has been for sale etc.
An offer is submitted in writing, subject to the property's technical and financial inspection (due diligence). (Due diligence) Usually, a reply is received the same day or as soon as the seller has the opportunity.
An offer will include the date of signing the purchase contract, the date of taking possession of the property and any reservations such as financing etc. An offer can be met with a counteroffer from the seller. The agent assists with negotiations until both parties achieve acceptance.
How to secure your investment?
A bid in Spain is not legally binding as it is in other countries. In Spain, when an offer is accepted, a deposit/reservation amount is paid with the intention of taking the property off the market.
A reservation contract is established, and the bidder can then, within a reasonable time (usually 2-6 weeks), carry out the necessary legal, technical and financial investigations of the property.
The reservation amount is usually 6,000 Euros for properties under 200,000 Euros. 8,000 Euros for properties up to 600,000 Euros, and 1% of the purchase price for properties above this.
Most people buying a property in Spain use a lawyer to draw up the purchase contract and check any encumbrances on the property, building permits, etc.
The seller is free to reject or negotiate with other operators until a final purchase contract is concluded between the parties.
The lawyer typically transfers the actual property and makes the property settlement.
We work with the best lawyers, valuers, and financial and tax advisors to secure your investment in Spain.
Property purchase costs account for 10-12% of the purchase price for second-hand homes and around 12% for new homes if VAT is included. Costs with a lawyer amount to 1 - 1.5% of the purchase price, depending on the complexity of the transaction.
