Contract negotiations

Once we have found the property you wish to buy, we will assist you with offers and negotiations with the seller's agent.
The choice of strategy in a negation process will be based on our knowledge of the price level of similar properties, knowledge of ownership, attractiveness in the market and how long the property has been for sale etc.

An offer is submitted in writing, subject to the property's technical and financial inspection (due diligence). (Due diligence) Usually, a reply is received the same day or as soon as the seller has the opportunity.

An offer will include the date of signing the purchase contract, the date of taking possession of the property and any reservations such as financing etc. An offer can be met with a counteroffer from the seller. The agent assists with negotiations until both parties achieve acceptance.

How to secure your investment?

A bid in Spain is not legally binding as it is in other countries. In Spain, when an offer is accepted, a deposit/reservation amount is paid with the intention of taking the property off the market.

A reservation contract is established, and the bidder can then, within a reasonable time (usually 2-6 weeks), carry out the necessary legal, technical and financial investigations of the property.

The reservation amount is usually 6,000 Euros for properties under 200,000 Euros. 8,000 Euros for properties up to 600,000 Euros, and 1% of the purchase price for properties above this.

Most people buying a property in Spain use a lawyer to draw up the purchase contract and check any encumbrances on the property, building permits, etc.

The seller is free to reject or negotiate with other operators until a final purchase contract is concluded between the parties.

The lawyer typically transfers the actual property and makes the property settlement.

Purchase costs

Property purchase costs account for 10-12% of the purchase price for second-hand homes and around 12% for new homes if VAT is included. Costs with a lawyer amount to 1 - 1.5% of the purchase price, depending on the complexity of the transaction.
